Stormwater Updates: Expanding Regulation to Half Acre, Redrafting Stormwater Management Manual

As you might be aware, the Department of Environmental Conservation is proposing to lower the threshold for requiring a stormwater permit from one acre to half an acre in the following cases: (1) construction or redevelopment of impervious surface of one half acre or more and (2) expanding an existing impervious surface by more than 5,000 square feet if the total resulting area is greater than one half acre.

The House Fish, Wildlife, and Water Resources this week will consider draft language to make these statutory changes, as well as to automatically change existing rules for one acre or more now apply to one half acre or more. However, as drafted the changes would not come into effect until “the effective date of the next amendments to the Stormwater Management Manual” (see below). The language might be attached to a different bill already in Committee.

Revisions to the Stormwater Management Manual

Following up on ongoing stakeholder engagement, DEC is holding another presentation and question/answer session on the proposed draft of the revised Vermont Stormwater Management Manual after workgroup feedback and participation during a prior stakeholder process. The Stormwater Program is inviting stakeholders to the Pavilion Auditorium in Montpelier to learn about the proposed draft revision and to provide comments, feedback, and ask questions.

The presentation is scheduled on Tuesday, March 15, from 8:30 am to 1:00 pm.  The Pavilion Auditorium is located in the State of Vermont Pavilion Building at 109 State Street, Montpelier. The Auditorium is located in the basement of the building.  BGS security staff at the kiosk located in the first floor Lobby will be able to direct anyone to the elevator.
